ESZ provides a comprehensive building management solution designed to simplify daily operations, increase transparency, and save time for property managers and residents.

A prerequisite for using the portal and application (maintenance of records on residential units, owners/tenants, records of financial obligations with payment deadlines, payment tracking, records of scheduled homeowners’ association meetings and adopted resolutions, etc.) is the registration of the Homeowners’ Association by the building manager/professional property manager, then registration of the end user, i.e., the resident (hereinafter collectively referred to as the: User).

During registration, personal data is collected for the purpose of registration and authentication, enabling the use of the application/portal, identification, and access to specific services. ESZ processes personal data solely for the purpose of meeting the User’s requirements and providing the services requested by the User. User data is treated as strictly confidential, and every method of data collection has a specific purpose and legal basis.

The User registers by completing the required fields and providing personal information. Based on the registration, ESZ processes the User’s data appropriately and implements security measures to prevent unauthorized access, disclosure, modification, or accidental destruction of data. Data processing is carried out using computers and/or IT-enabled tools. For operation and maintenance, this application and its associated services collect files that record interaction with the application (system logs). Personal data is processed in accordance with the applicable Personal Data Protection Law.

Personal data will not be processed beyond the purpose for which it was collected, except in cases where processing is carried out by and under the supervision of competent authorities, as prescribed by law. ESZ takes all necessary data protection measures in accordance with established standards and procedures to safeguard data from loss, destruction, unauthorized access, disclosure, and any other misuse. Collected information is not disclosed to or shared with organizations outside the ESZ system development and administration framework, except where required by law. Data will not be used for purposes that are not legally compliant.

ESZ may use and process User data required during the portal registration process and for the purpose of providing services selected by the User through the application/portal.

By opting to receive the latest news and information from ESZ, the User consents to ESZ using the User's registered contact information for communication purposes and the delivery of various notifications. Such messages and notifications are not considered spam, unfair competition, harassment, or unauthorized advertising. The User may withdraw this consent at any time through the available options on the portal/application.

ESZ is not responsible for the loss or theft of the User’s password or for its unauthorized use. By registering, you agree to immediately notify ESZ of any unauthorized use of your account or any other security breach. During registration, the User provides an email address and password. The User’s email address must be unique within the system for registration to be successful. It is recommended that the password contain a combination of uppercase and lowercase letters, special characters, and numbers, and that it be at least 8 characters long. ESZ reserves the right to modify the password requirements and parameters.

The User is responsible for safeguarding their email address and password used to access the application. In the event that a third party gains unauthorized access to and uses the User’s email address and password to access the portal and/or application, ESZ shall not be held liable. If the User suspects unauthorized use of their email address or password, the User shall remain responsible for any activity conducted under their credentials until ESZ has been notified of such suspected unauthorized use. The User is also responsible for all unauthorized activities performed or authorized through the use of their email address and password.

To minimize the risk of misuse of the User’s data, it is recommended that the User: refrain from providing inaccurate information during registration; keep identification data, email address, and password confidential; prevent third parties from gaining unauthorized access to or using such information; and notify ESZ immediately upon becoming aware of any unauthorized use or misuse of their email address or password. If the User fails to comply with the above instructions or other security measures, ESZ shall not be liable for any damages suffered by the User or for any claims asserted against the User by third parties, particularly damages resulting from the improper use of the User’s data by the User or third parties. The User acknowledges and agrees that use of the operator’s website is undertaken at the User’s own risk and responsibility. The Internet is an international computer network that is not under the direct control of ESZ. ESZ makes no warranties and assumes no liability for any damages incurred through the use of the service or application, nor shall ESZ be liable for any claims brought by third parties.

The User shall use the operator’s website in compliance with all applicable laws and regulations. The User shall not use the operator’s website in any manner that may cause damage to, or jeopardize the interests or security of ESZ or any third party. Services available through the website are intended solely for private and non-commercial purposes and may not be misused by the User. Documents, data, and information published on the operator’s website may not be reproduced, distributed, or otherwise used for commercial purposes without the express consent of ESZ.

Documents, data, and information published on the operator’s website may be used solely for the User’s individual needs and only in compliance with all copyright, ownership, and third-party rights. If the User acts contrary to these provisions, ESZ reserves the right to terminate or suspend the User’s access to the service. The User agrees and warrants that any materials transmitted through the operator’s website do not violate applicable laws and regulations, including, but not limited to, intellectual property rights, the privacy rights of third parties, criminal laws, electronic communications regulations, personal data protection laws, and any other applicable laws of the Republic of Serbia. In the event that the User acts contrary to this provision or in any other manner contrary to applicable laws and regulations, ESZ shall not be held liable, and liability shall rest solely with the User. ESZ shall be entitled to claim compensation for damages from the User, in the amount requested by ESZ.

The services available through the Operator’s website shall not be used for the collection of e-mail addresses or other contact information, nor for any other unauthorized purposes; for the transmission of unsolicited communications; for interfering with the operation of websites; for the use of automated scripts or similar tools to collect information from websites; for providing false, inaccurate, or misleading information or identification data; for publishing inappropriate, offensive, or unlawful content, infringing upon the rights of third parties, or otherwise causing harm to, or endangering, ESZ or any third party; for the misuse of the systems, data, or services of ESZ or third parties; or for creating, publishing, or distributing content that is contrary to applicable laws and regulations or otherwise harmful in nature.

With respect to the foregoing content that constitutes a misuse of the User’s rights or infringes upon or jeopardizes the rights of ESZ or any third party, ESZ reserves the right to remove such content or restrict its further distribution or visibility without prior notice to the User and without obtaining the User’s consent.

ESZ reserves the right to perform periodic maintenance of its systems, during which the services may be temporarily unavailable. ESZ shall not be liable for any temporary unavailability of the services or for any loss of stored data resulting from maintenance activities, unexpected and unforeseen technical failures, system malfunctions, or service interruptions caused by circumstances beyond ESZ’s reasonable control. ESZ assumes no responsibility for User-generated content.

ESZ is under no obligation to retain or store User data for any indefinite period of time. ESZ shall not be liable for any loss of profits, loss of data, indirect, incidental, consequential, special, or punitive damages, or for any damages arising from claims made by Users or third parties. The User agrees not to hold ESZ liable for any errors in the operation of applications, deletion or loss of data, deficiencies in the provision of services, or delays in the transmission of data. Furthermore, ESZ shall not be responsible for the completeness, accuracy, reliability, or timeliness of any data made available to the User through the Operator’s website and/or application.

ESZ hereby expressly disclaims any and all liability arising from or in any way related to: (i) the use of the Operator's website; (ii) any acts or omissions of the User in connection with the use or misuse of any content available through the Operator's website; and (iii) any loss, damage, liability, cost, or expense incurred by the User or any third party as a result of, or in connection with, the use or misuse of content available on the Operator's website and/or application.

ESZ reserves the right, in accordance with its business policies, to modify the fees and charges applicable to the use of its services, provided that Users are duly notified of such changes by means of an appropriate notice published on the website. The User acknowledges and agrees that ESZ shall not be liable for any loss or damage arising from the restriction, suspension, or termination of access to the services and/or applications, regardless of the reason for such restriction, suspension, or termination.

ESZ reserves the right, at any time and at its sole discretion, to amend these Terms of Use and the Privacy Policy, and any content available on the Operator's website and/or application. Upon publication of the amended Terms of Use and Privacy Policy, such amended terms shall become binding upon the User. The User shall be deemed to have accepted the amended Terms of Use and Privacy Policy, and any other modifications if the User continues to access or use the services and/or applications made available through the Operator's website. If the User does not agree with any such amendments or no longer wishes to use the application, the User shall notify ESZ accordingly through the available communication channels.
